§ 1 Scope and provider

These terms apply to all orders placed by consumers through the Hawk Foundation website. Your contractual partner is the Hawk Foundation, a Domestic Nonprofit Corporation registered in the US state of New Mexico ("we"). Hawk Foundation is a brand of Hawk Foundation. § 2 Products and purpose

Every order combines a merchandise item with a contribution to animal rescue programs (foster homes, vet costs, transport and adoption). We are not an organization recognized as charitable in Germany. Purchases and contributions are not tax-deductible; no donation receipts are issued.

§ 3 Conclusion of contract

The presentation of items on the website is not a legally binding offer but an invitation to order. By clicking "Continue to payment" and completing checkout, you submit a binding offer. The contract is concluded when we confirm the order by email. The contract language is German.

§ 4 Prices

All prices are in US dollars ($) and include statutory VAT where applicable. Shipping costs may apply and are shown before you complete your order (see Shipping & Delivery). The price shown at the time of ordering applies.

§ 5 Payment

Payment is processed by the payment provider Stripe once online payment is enabled; until then, orders cannot be paid. The payment methods shown at checkout are offered, in particular common credit and debit cards. Payment is due upon completing the order. We do not store full card details.

§ 6 Delivery and customs

We deliver to addresses in Germany. Details are under Shipping & Delivery. Shipping costs, delivery time and any import duties are stated before you complete your order.

§ 7 Right of withdrawal

Consumers have a statutory right of withdrawal. Details are in our Withdrawal Policy.

§ 8 Cancellation

In addition to the right of withdrawal, you may cancel an order free of charge within 24 hours of purchase as long as it has not yet shipped. Write to contact@hawkfoundation.org with your order number.

§ 9 Warranty

Statutory warranty rights apply. If an item is damaged or defective, please contact us — we will send a free replacement or refund the full amount.

§ 10 Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slightly negligent breaches of essential contractual obligations, liability is limited to foreseeable damage typical for the contract. Liability under the Product Liability Act remains unaffected.

§ 11 Intellectual property

All content on this website — text, images, logos, design and code — is protected by copyright and may not be reproduced, distributed or used without our prior written consent.

§ 12 Applicable law

If you are a consumer habitually resident in Germany, you retain in any case the protection of the mandatory consumer protection provisions of German law.
